Can a Parent Stop Paying Child Support Because Visitation Is Denied?

Family Law

When parents disagree over visitation arrangements, financial support sometimes becomes another source of conflict.

A parent may feel that being prevented from seeing a child justifies withholding financial support.

But parental financial obligations and visitation rights are distinct legal matters.

Under the applicable personal status laws and judicial decisions, a parent's duty to contribute to a child's maintenance is not ordinarily extinguished simply because disagreements arise over visitation.

Likewise, disputes concerning financial support should not automatically become a justification for obstructing a child's relationship with a parent.

Where a court has established financial or visitation obligations, any requested modification should be pursued through the appropriate legal procedures.

What you should know: Do not assume that a dispute over one parental obligation gives you the right to disregard another. Seek appropriate legal remedies rather than taking unilateral action.

Because children should never have to pay the price of disagreements between their parents.
